Plain-language summary (not a substitute for the full terms): Welance is a booking platform that connects you with independent beauty and wellness professionals. We are not the provider of those services, we do not employ professionals, we do not hold their money, and we do not take a commission on their work. We charge a small booking fee to clients and an optional listing subscription to professionals. We do not offer in-app chat. Illegal or adult services are strictly forbidden.
1. Who we are
Welance (“Welance,” “we,” “us,” or “our”) is a software platform operated by a limited liability company organized under the laws of the United States. These Terms of Service (“Terms”) form a legally binding agreement between you and Welance and govern your access to and use of the Welance mobile applications, websites, and related services (collectively, the “Platform”).
By creating an account, accessing, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy and Refund Policy, which are incorporated by reference. If you do not agree, you must not use the Platform.
2. The nature of the platform — a neutral venue
Welance is a neutral technology venue that enables clients (“Clients”) to discover and request appointments with independent third-party beauty and wellness professionals (“Professionals”). Categories include hair styling, nail care, lash extensions, facial treatments, skin and body care, and massage therapy.
You acknowledge and agree that:
- Welance does not provide any beauty, wellness, massage, or personal-care service of any kind.
- Professionals are independent businesses or individuals, not employees, agents, partners, or representatives of Welance.
- Welance does not direct, supervise, or control the manner, means, quality, legality, pricing, or outcome of any service provided by a Professional.
- Any contract for services is formed solely between the Client and the Professional. Welance is not a party to that contract.
- Welance makes no representation that any Professional holds the licenses, certifications, or insurance required in their jurisdiction. Clients and Professionals are each responsible for their own legal and regulatory compliance.
3. Eligibility & accounts
You must be at least 18 years old and legally capable of forming a binding contract to use the Platform. You agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account.
You may sign in using third-party identity providers (such as Apple or Google). You authorize us to receive limited profile information from those providers strictly to create and secure your account, as described in our Privacy Policy.
4. The role of professionals
Professionals who list on the Platform represent and warrant on a continuing basis that they:
- are lawfully permitted to offer the services they list, and hold all licenses, permits, registrations, and insurance required in their jurisdiction;
- own or have the right to use all content (photos, descriptions, business name) they upload;
- will provide services in a professional, lawful, safe, and hygienic manner;
- set their own prices, hours, and service descriptions, and are solely responsible for them;
- are solely responsible for the declaration and payment of any taxes arising from their activity.
Professionals are independent contractors operating their own businesses. Nothing in these Terms creates an employment, agency, partnership, or joint-venture relationship between a Professional and Welance.
5. Bookings & the booking fee
The Platform allows a Client to request a specific appointment time from a Professional's calendar. A request becomes a confirmed appointment only when the Professional approves it within the applicable response window and the Client pays the booking fee.
The booking fee is a charge paid by the Client to Welance for the use of the Platform's matching, scheduling, and verified-contact-unlock functionality in connection with a confirmed appointment for an in-person service. The booking fee is not payment for the underlying service. The price of the service itself is agreed and paid directly between the Client and the Professional, separately from the Platform.
Important: The booking fee is a fee for a real-world, in-person appointment-booking service. It is not a purchase of digital content, in-app currency, or any digital good consumed within the application.
6. Payments & payment processors
All payments on the Platform are processed by third-party payment processors, including Stripe, Inc., and where applicable Apple Pay and Google Pay. By making a payment, you also agree to the applicable processor's terms.
- Welance does not collect, process, transmit, or store full payment card numbers or financial credentials. These are handled exclusively by our PCI-DSS-compliant processors.
- Welance does not take custody of, escrow, or hold funds owed to Professionals for their services. Service fees flow directly between Client and Professional.
- Welance does not charge any commission or percentage on a Professional's service earnings.
- Currency conversion, where shown, is indicative; the final charged amount and rate are determined by the payment processor.
7. Subscriptions & no automatic renewal
Professionals may purchase optional listing plans that make their profile visible for a defined period (for example, one week or four weeks). Clients may, where offered, purchase an optional plan affecting booking-fee terms.
All plans are fixed-term purchases of platform access and do not renew automatically. When a plan expires, no further charge is made; a Professional's profile is simply hidden until they choose to purchase a new term. Appointments already confirmed before expiry remain valid. Where a plan is purchased through Apple or Google, management and cancellation are also subject to the relevant store's rules.
8. Refunds & cancellations
Refund and cancellation terms are set out in full in our Refund Policy, summarized here:
- If a Professional does not respond to a request within the response window, the request expires and no booking fee is charged.
- If a Professional cancels a confirmed appointment, the Client's booking fee is refunded in full.
- Because the booking fee unlocks verified contact details immediately upon a confirmed booking, it is otherwise non-refundable once that value has been delivered, except where required by applicable law.
- Disputes about the underlying service are between the Client and the Professional; Welance may assist but is not financially responsible for the service.
9. Verification & reviews
Professionals must verify each contact number through the relevant messaging platform before that contact becomes visible. Unverified contact details are never displayed. A Professional's working location is verified by GPS during onboarding and cannot be manually altered.
Verification confirms control of a contact channel and a location; it is not a background check, an endorsement, or a guarantee of a Professional's identity, skill, licensing, or conduct. Reviews are submitted by Clients in connection with completed appointments and reflect their personal opinions, for which Welance is not responsible. You agree not to submit false, defamatory, or manipulated reviews.
10. No in-app communication service
Welance does not provide an in-app chat, messaging, calling, or content-exchange service. After a booking is confirmed, the parties receive each other's verified contact details and communicate using independent third-party messaging services of their own choosing. Welance is not a communications carrier, does not transmit or store the parties' conversations, and bears no responsibility for communications conducted off-Platform.
11. Prohibited conduct
The following are strictly prohibited and will result in immediate removal and, where appropriate, referral to authorities. You must not use the Platform to offer, solicit, facilitate, advertise, or engage in:
- any sexual, escort, “adult,” or otherwise illegal service, or any service that is a pretext for the foregoing;
- human trafficking, exploitation, or any service involving a minor;
- any service that is unlicensed where a license is legally required, or that violates any applicable law or regulation;
- fraud, money laundering, impersonation, or misrepresentation of identity, qualifications, or location;
- harassment, threats, discrimination, hate speech, or violence;
- circumventing the booking flow to evade fees, or scraping, reverse-engineering, or interfering with the Platform;
- uploading content that infringes intellectual-property rights or that is unlawful, deceptive, or obscene.
Zero tolerance. Welance is a beauty and wellness platform. Any attempt to use it for sexual, adult, or otherwise illegal services results in a permanent ban and may be reported to law-enforcement and payment partners.
12. Location & matching rules
The Platform uses device location to match Clients with Professionals in the same city, and applies distance and same-country rules to reduce fraud and irrelevant matches. Location permission may be required to use core features. You agree not to falsify, spoof, or manipulate location data.
13. Disclaimers
THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WELANCE DOES NOT WARRANT THE QUALITY, SAFETY, LEGALITY, OR SUITABILITY OF ANY PROFESSIONAL OR SERVICE, THE ACCURACY OF ANY LISTING OR REVIEW, OR THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE. YOU USE THE PLATFORM AND ENGAGE PROFESSIONALS AT YOUR OWN RISK.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WELANCE AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR PERSONAL INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM OR ANY INTERACTION WITH A PROFESSIONAL OR CLIENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. IN NO EVENT WILL WELANCE'S TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO WELANCE IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
15. Indemnification
You agree to indemnify, defend, and hold harmless Welance and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Platform; (b) your provision of, or engagement of, any service; (c) your breach of these Terms or any law; or (d) your infringement of any third-party right.
16. Suspension & termination
We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms, created risk or legal exposure for Welance, or engaged in prohibited conduct. Professionals who repeatedly fail to honor confirmed appointments, or who receive substantiated reports of misconduct, may be permanently removed. You may stop using the Platform and request account deletion at any time as described in our Privacy Policy.
17. Governing law & dispute resolution
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, except where mandatory local consumer-protection law applies to you. The parties will first attempt to resolve any dispute informally by contacting legal@welance.app. Any dispute not resolved informally shall be subject to the exclusive jurisdiction of the competent courts located in Delaware, United States, unless applicable law grants you the right to bring proceedings elsewhere. Nothing in this section deprives you of mandatory consumer rights in your country of residence.
18. Changes & contact
We may update these Terms from time to time. Material changes will be notified through the Platform or by other reasonable means, and the “Last updated” date above will change. Continued use after changes take effect constitutes acceptance. If you do not agree, you must stop using the Platform.
